113 Mr. N. Treacy asked the Minister for Agriculture, Food and Forestry the reason payments have not been made to a person (details supplied) in County Galway; the date on which payment will be made; if his attention has been drawn to the urgency of the situation; and if he will make a statement on the matter. An application for subsidy towards the purchase price of milk quota acquired under the 1996 subsidised restructuring scheme was received in my Department in the name of a person believed to be the late father of the person named. Further documentation has been sought from the person named in order to establish that he is the successor-in-title to the quota lands and, if so, that he satisfies the eligibility criteria of the scheme. On receipt of this documentation the subsidy will be paid without delay.

The REP scheme includes provision for compliance checks prior to the making of second year payments. As a result of such a check, the applicant incurred a penalty for his failure to comply fully with the terms of the scheme. He was given a period of time in which to appeal this decision, if he so wished, but has failed to do so. His application is now being processed and payment, less the penalty, will issue shortly.
