Question:

272 Mr. J. Walsh asked the Minister for Enterprise and Employment if he will approve an application for a work permit for a person (details supplied) in County Cork. [9589/97]

I can confirm that an application for a work permit was submitted in respect of the named person (details supplied) on 20 June 1996. On 15 July 1996, the employer informed the work permits section of my Department that he wished to cancel this application. As no further application for a work permit has been submitted in respect of the named person, no decision can be made regarding the issue or refusal of a permit on her behalf.

Applications for work permits are considered under the Aliens Act, 1935, the Aliens orders 1946 and 1975 and the European Communities (Aliens) Regulations 1977-93. Work permits are only granted where my Department is satisfied that the vacancy cannot be filled by an Irish-EEA national.

I understand that the named person entered the State as a visitor and has been permitted by the Department of Justice to remain in the State on condition that she is of independent means. I should say that this is a factor which would have to be taken into account if a work permit application was being considered on her behalf.
