Question:

57 Mr. Ellis asked the Minister for Arts, Culture and the Gaeltacht if his Department will pay compensation due as part of the Shannon and Erne waterway to a person (details supplied) in County Leitrim. [11539/97]

The valuer has been in discussion with the claimant's solicitor and an offer has been made, which, I understand is not acceptable to the claimant. It is now open to the claimant, in accordance with the procedures set down in the legislation, to have the matter determined by the property arbitrator.

58 Mr. Ellis asked the Minister for Arts, Culture and the Gaeltacht if his Department will pay compensation due as part of the Shannon and Erne waterway to a person (details supplied) in County Leitrim. [11540/97]

A claim for compensation in respect of the lands referred to by the Deputy was received in April 1992. The claimant subsequently informed the valuer that he did not wish to pursue the claim which had been lodged, and he indicated that he would be submitting a new one. No such new claim has been received.

59 Mr. Ellis asked the Minister for Arts, Culture and the Gaeltacht if he will have arrangements made to provide a proper fence on lands (details supplied) which are used as part of the Shannon and Erne waterway. [11541/97]

The Waterways Service of my Department as part of its maintenance programme, is engaged in improving access along the banks of the Shannon-Erne Waterway, including the area referred to by the Deputy. Those lands adjoin the access strip where works are ongoing. A total length of about 30 meters of the permanent boundary fence, was subject to interference during the course of the works. This fence has since been re-instated by the Waterways Service.
