Liam Aylward

Question:

101 Mr. Aylward asked the Minister for Agriculture and Food if he will have arrangements made to have arrears under the farm retirement scheme paid to persons (details supplied) in County Kilkenny whose application was approved in 1995 although payment was not made until February 1996, in view of the policy currently being adopted by his Department not to penalise applicants under this scheme where unavoidable delays were caused in the processing of documents relating to the application. There was no undue delay in dealing with this case. The application was received in the local office on 17 November 1995. A dealing number was submitted on 22 December and the application was validated for payment on 5 January 1996. The question of arrears does not therefore arise.

Question:

102 Mr. Finucane asked the Minister for Agriculture and Food the final determination on the appeal to the REP scheme appeal committee for a person (details supplied) in County Limerick; and if he will make a statement on the matter. [16227/97]

The appeal against a penalty imposed on this second year payment by the applicant named has been considered by my Department's REP scheme appeal committee. The committee decided to uphold the penalty and the application was informed of this decision on 1 July 1997.
