Question:

370 Mr. McGrath asked the Minister for Justice, Equality and Law Reform the number of child custody orders applied for and granted in marital breakdown situations, including the ratio of orders made to mothers or fathers, for the period for which records are available. [18836/97]

Applications for custody orders are made pursuant to section 11 of the Guardianship of Infants Act, 1964 and such applications are generally made to the District Court. Statistics on the number of section 11 applications dealt with by the District Court in the legal years ending 31-07-93 to 31-07-96 together with the number of orders granted are set out in the following table.

In judicial separation cases the Circuit Court can also make custody orders under section 11 of the Guardianship of Infants Act, 1964. In the year ending 31 July 1996, 463 custody orders were made in the Circuit Court in conjunction with judicial separation applications. No information is available on the gender of the applicants in either case.
