141 Mr. Perry asked the Minister for Agriculture and Food if he will rectify the decision made by his Department for co-operatives (details supplied) in County Sligo in relation to the superlevy liability in view of the fact that it penalises a number of suppliers in the area and the two co-ops work in partnership; and if he will make a statement on the matter. The superlevy liability is established at the level of the milk purchaser in accordance with provisions of EU regulations. Both concerns referred to in the question are registered separately in the register of milk purchasers maintained by my Department under regulation 17 of the European Communities Milk Quota Regulations, 1995 (S.I. No. 266 of 1995).

As there is no provision in the regulations for the transfer of unused quota between two separate milk purchasers, the co-operative mentioned, which incurred the super-levy liability, must, therefore, discharge it in full together with accrued interest.
