150 Mr. Aylward asked the Minister for Agriculture and Food if a final decision has been made on the appeal by a person (details supplied) in County Kilkenny on his disqualification from the suckler cow scheme. [20978/97]

The person concerned was disqualified from the 1997 suckler cow premium scheme following an inspection of his herd on 23 July 1997 when it was found that he applied for premium on an ineligible animal.

The person named sought a review of that decision and a review was carried out. The result of the review was communicated to the person concerned on 24 October 1997 and he was allowed 21 days in which to lodge an appeal if he was dissatisfied with the outcome. No further appeal was lodged.

The person named will be paid his entitlement under the 1997 cattle scheme within the next week.

154 Mr. Kenny asked the Minister for Agriculture and Food if he will have arrangements made to issue payment to a person (details supplied) in County Mayo who is entitled to payment but due to difficulties outside his control has been unable to receive this payment. [21016/97]

This application is one of a number which include grazing rights on a large estate in County Mayo.

Under the terms and conditions of the REP scheme, aid cannot be paid on grazing rights which are not registered in the applicant's name unless the rights can be converted into a definite area entitlement. The planners concerned have been requested to clarify all the legal entitlements on this estate to determine the relevant areas eligible for REPS. When this has been done the application in question will be further processed.

156 Mr. Boylan asked the Minister for Agriculture and Food the reason a person (details supplied) in County Cavan has not received headage payment for each of the years from 1995 to date in 1997 in view of the fact that he acknowledges a very minor error on his application of 1995 and this was due to his wife's death; if his Department will make payment on compassionate grounds and overlook the minor error in this regard. The person named applied on 12 animals under the 1994 suckler cow premium scheme and on the same animals under the 1994 cattle headage scheme. At an inspection on 22 December 1994, ten of the cows applied on were absent and replaced with nine other cows and one in-calf heifer, as allowed under both schemes. The person named was requested to forward sales dockets for the original cows and purchase dockets for replacement animals. Final documentation was not received by my Department until 5 November 1996. However, adequate documentation on the sale of two animals applied on under the 1994 suckler cow scheme was not received and the matter continues to be investigated.

With regard to the 1994 cattle headage scheme application by the person named, one of the animals applied on as a cow was discovered from the sales docket supplied to be a heifer. In accordance with condition 19(b) of the terms and conditions of the scheme, the applicant was ruled out of the scheme for 1994 and 1995. The person named did not apply under the 1996 cattle headage or suckler cow premium schemes or the 1997 suckler cow premium scheme. He will be paid his entitlement under the 1997 cattle headage scheme within the next week.

The area aid application of the person concerned has been randomly selected for inspection in accordance with EU regulations. The result of the inspection should be available within the next two weeks and payment will issue shortly thereafter subject to the inspection results being satisfactory.

An unsigned area aid application form was received from the person named. This unsigned application was returned to the person named requesting his signature. When this application is returned duly signed payments can issue to the herd owner.

My Department has no record of having received an application for the 1997 sheep headage grants from the person concerned.

He applied for 1997 ewe premium in respect of 28 ewes. He holds a quota of 20 ewe premium rights. His full entitlement under the first instalment of ewe premium was £181.01. This payment did not issue as it was offset along with a sum of £160 due under the 1996 BSE top-up against an overpayment under 1996 special beef premium.

Further examination of this case has established that the total amount offset has exceeded the amount of overpayment involved in the 1996 special beef premium scheme. A refund of £114.71 is now due to the person concerned and payment of this amount will issue shortly.

The person named was paid his full entitlement of £1,000 under the 1997 sheep headage scheme today.

The person named cannot be paid his 1997 cattle headage grant at present as he is not a registered herdowner under the BTE scheme as required under the terms and conditions of the cattle headage scheme. The person named should apply to his local district veterinary office to be registered as a herdowner and when registration is completed, he will receive his full entitlement under the 1997 cattle headage scheme.

174 Mr. Creed asked the Minister for Agriculture and Food if an application (details supplied) for ten month beef premium which was submitted in December 1996 can be treated as a 1997 application in view of the fact that the applicant was under the impression that an early application would ensure prompt payment but has found this application has been disqualified. The person named applied on seven animals under the ten months special beef premium scheme in December 1996. As this application brought him above his stocking density limit for the year his payments were, accordingly, restricted by that stocking density limit.

The EU Commission has indicated that applications cannot be withdrawn to avoid the imposition of stocking density limits.

If, in the case of the person named, his applications had not been restricted, his December application would have been paid substantially sooner than if his application had been lodged the following January.
