241 Mrs. Owen asked the Minister for Justice, Equality and Law Reform further to Parliamentary Question No. 305 of 9 December 1997, if his Department will arrange to amend the Garda Síochána pension order to allow for the payment of a pension to a person (details supplied) who is deemed ineligible to receive a widow's pension in spite of being married for 25 years to a member of the force. [23164/97]

Amendment of the Garda Síochána Pensions Orders would not provide a solution in this case.

The non-award of a pension to the applicant in this case arises not from the provisions of the Garda Síochána Pensions Orders but from the fact that the applicant was not lawfully married to the member at the time of his death.

An amendment of the Pensions Orders to cater for this particular case could have the effect of depriving a lawful spouse of the entitlment to receive a pension on the death of a former member.
