44 Mr. Penrose asked the Minister for Justice, Equality and Law Reform the number of occasions, if any, the Director of Public Prosecutions has sought to appeal against inconsistent sentencing under the Criminal Justice Act, 1993; and if he will make a statement on the matter. [3212/98]

My Department has been informed by the office of the Director of Public Prosecutions that the Director has appealed against leniency in five cases. As the Deputy will be aware, the Director is independent in the exercise of his functions and, it would be inappropriate for me to make any further comment in the matter.
