Question:

255 Mr. Hayes asked the Minister for Justice, Equality and Law Reform if he will make a statement on the situation in relation to persons (details supplied) in Dublin 24 who have recently been informed by the Land Registry Office that the sum of money paid in 1985 to obtain a freehold on a property was never received by the Land Registry Office or registered accordingly; and if he will look compassionately at the situation or employ an arbitrator at the Land Registry Office to adjudicate on the matter in view of the exceptional circumstances that surround this case. I am informed by the Registrar of Titles that there is no record of any application ever having been made to acquire the freehold of the property identified by the Deputy.

However, I am further informed that this property was subject to a charge in favour of Dublin County Council and that this has now been redeemed. I understand that this charge is currently being cancelled from the folio and notice of completion will issue within the next week.

It may be the case that this is the dealing referred to in the question. If not, I will have further inquiries made in the matter if the Deputy can write to me with more specific details of the case and-or copies of any relevant correspondence from the Land Registry.

Appropriate forms to initiate the acquisition of the freehold on properties are available from the Ground Rents Section, Irish Life Building. If moneys have already been paid to the ground landlords and the consent form has not been received, the applicants should approach the ground landlord with a view to having the form signed. If they are unable to obtain the freehold by consent of the parties they may avail of the arbitration procedure. Full details may be obtained from the Ground Rents Section of the Land Registry.
