Question:

104 Mr. Aylward asked the Minister for Justice, Equality and Law Reform if he will have arrangements made to expedite an application for registration by a person (details supplied) in County Kilkenny. [5377/98]

I am informed by the Registrar of Titles that this dealing refers to an application under section 49 — i.e. Acquisition of Title by virtue of long possession — of the Registration of Titles Act, 1964, and a Transfer of Part. I understand that due to their complicated nature, applications under section 49, which require detailed examination of the applicant's claim for registration as owner, take some time to process.

I am further informed that notice will shortly be served on all parties whose interests may be affected by the application in so far as such parties can be identified. If no objections are received within one month the case will be considered for completion. The Deputy may wish to note that the Transfer of Part cannot be processed until the section 49 application is completed.
