428 Mr. Allen asked the Minister for Education and Science the reason his Department is not prepared to enter into discussions with a company (details supplied) in Dublin 3 which is in receivership in relation to a premises presently leased by that company at Clontarf, Dublin 3 in order to ensure the continuation of the leisure facility at that address. [7328/98]

Officials of my Department met with the receiver appointed to the company on 10 March.

My primary responsibility as regards the premises concerned is to protect the public interest in it as a publicly owned asset. In doing so it is also my objective to ensure the continuing use of the premises as a sport-leisure facility. I am not satisfied that I can discharge my responsibility or meet that objective by entering into a lease with the company, which is now in receivership and to which a liquidator has been appointed. I consider that the appropriate course to adopt is to regain possession of the property and to enter into a new agreement with an appropriate tenant for the letting of the property as a sport-leisure facility. In order to achieve vacant possession of the property, a Notice to Quit has been served on my behalf on all parties concerned with the property, including the company.
