Question:

104 Mr. Fleming asked the Minister for Defence the details of all severance payments, statutory redundancy payments, payments for untaken leave and minimum notice payments made to all ministerial personal staff, programme managers, special advisers, personal assistants, personal secretaries and civilian drivers arising from the change of Government in 1997. [7927/98]

The payments made to ministerial contract staff in respect of severance payments, statutory redundancy payments, payments for untaken annual leave and payments made in accordance with the provisions of the Minimum Notice and Terms of Employment Act are as follows:

The contract of the programme manager was administered by the Department of the Marine (as it was then) and details in respect of payments made to him on termination of contract will be provided by the Minister for the Marine and Natural Resources.

105 Mr. Fleming asked the Minister for Defence the number of days of untaken leave for all ministerial personal staff, programme managers, special advisers, personal assistants, personal secretaries and civilian drivers arising from the change of Government in 1997; the contractual obligations on these staff for the keeping of leave sheets; if leave sheets were kept in accordance with their contracts; if the staff complied with the usual Civil Service conditions regarding the granting of annual leave and the making of returns of annual leave taken; and, if not, the way in which untaken leave was verified in each case. The number of untaken days annual leave in respect of ministerial contract staff whose employment terminated as a result of the change of Government in 1997 was as follows: special adviser, 24 days; personal assistant, 7 days. Their contracts of employment stated that the annual leave allowance was subject to the usual conditions regarding the granting of such leave but did not specifically refer to the maintenance of leave sheets. In this instance it appears that formal leave sheets were not maintained. The granting of annual leave is a function delegated to line management in the Department of Defence. The office of the Minister monitors leave arrangements for ministerial contract staff. The Deputy may be assured that there was full reconciliation of annual leave entitlements at termination of contract stage.

106 Mr. Fleming asked the Minister for Defence the details of all severance payments, statutory redundancy payments, payments for untaken leave and minimum notice payments made to any ministerial programme managers, special advisers, personal assistants, personal secretaries and civilian drivers who resigned before the change of Government in 1997; if these payments were provided for in their contracts or were legally claimable; and, if not, the reasons the payments were made. [7955/98]

No such payments were made.

107 Mr. Fleming asked the Minister for Defence if any ministerial programme managers, special advisers, personal assistants, personal secretaries and civilian drivers received severance, statutory redundancy, untaken leave or minimum notice payments in 1994 arising from the change of Government; and if they also received similar payments in 1997 arising either from their resignation or from the change of Government. [7969/98]

There were no instances where this occurred in the Department of Defence.
