Question:

3 Mr. Yates asked the Minister for Public Enterprise if she will publish the detailed terms and condition relating to the issuing of MMDS licences in 1989; and whether there is a clause to revoke a licence where there is not coverage available to householders. [8494/98]

MMDS licences are confidential to the licensee and the licenser i.e. the Director of Telecommunications Regulation. The licences were granted in response to a public advertisement seeking applications for licences for a series of franchise areas.

The form and content of such licences is prescribed in the Wireless Telegraphy (Television Programme Retransmission) Regulations, 1989. Regulation 13(2) of those regulations prescribes that the licensor may revoke or suspend a licence where the number of premises served by a licensee is less than the minimum number prescribed in the licence. It is a matter for the Director of Telecommunications Regulation to ensure compliance with this requirement.
