Question:

115 Dr. Upton asked the Minister for Foreign Affairs if Ireland will make a declaration accepting the jurisdiction of the European Court of Justice to give preliminary rulings on Third Pillar matters in view of the fact that all our EU partners, with the exception of Britain and Denmark, have made, or are expected to make, a declaration at the time of ratification of the Amsterdam Treaty; if so, when will this declaration be made; and if he will make a statement on the matter. The question of making a declaration under the terms of Article K.7 of the Amsterdam Treaty is under consideration. The Department of Foreign Affairs is in consultation with the Department of Justice, Equality and Law Reform and the Office of the Attorney General on the matter. As the Deputy will be aware, under the provisions of the Treaty such a declaration may be made at the time of signature or at any time thereafter. Should the Government decide to proceed with such a declaration, the matter will be brought forward for consideration by both Houses of the Oireachtas.
