119 Ms Fitzgerald asked the Minister for Public Enterprise the proposals, if any, for legislation being prepared under the auspices of her Department that have not yet been published; and the statutory instruments, if any, being prepared in her Department. [13978/98]

1.

Carriage of Dangerous Goods by Road Bill

To enable Ireland to accede to the European Agreement on the International Carriage of Dangerous Goodds by Road (ADR) and to transpose into Irish law Council Directive 94/55/EC of 21 November 1994 on the approximation of the laws of the member states with regard to the transport of dangerous goods by road and Council Directive 95/50/EC of 6 October 1995 on uniform procedures for checks on the transport of dangerous goods by road.

2.

Radiological Protection (Amendment) Bill 1998

To update certain powers and functions of the Radiological Protection Institute of Ireland.

3.

Telecommunications (Infrastructure) Bill

To provide for the amendment of the powers of telecommunications network operators in relation to the use of lands and public roads for the purpose of establishing telecommunications infrastructures by network operators; and other related matters.

4.

Telecommunications (Regulation) Bill

To provide for the extension of certain powers of the Director of Telecommunications Regulation; and to update the regulatory framework in the light of the forthcoming full liberalisaton of the sector.

5.

Electricity Bill

To give effect to restructured electricity industry.

6.

ESB Bill

Conversion of ESB from a Statutory Corporation into a Public Limited Company (Plc).

7.

Road Transport Bill (Revised)

Road Transport Bill to amend the existing licensing provisions under the Road Transport Acts 1933-1936 and to amend certain sections of the Road Traffic Acts dealing with overweight vehicles.

8.

Geological Survey of Ireland (GSI) Bill

Updating of GSI Legislation, 1845.

9.

Telecommunications (Miscellaneous Provisions) Bill

To amend telecommunications legislation to enable the State to reduce its interest in Telecom Éireann to a minority shareholding and other related matters to facilitate an Initial Public Offering in June 1999.

10.

Irish Energy Centre Bill

To establish the Irish Energy Centre as an independent agency under the auspices of the Department.

Question:

120 Ms Fitzgerald asked the Minister for Public Enterprise the Acts and provisions of Acts under the auspices of her Department which, as of 1 June 1998, are not in force because a commencement order has not been made; whether it is proposed to make an order in each case; and, if so, when this will be made. [13993/98]

A commencement order has not been made in respect of Part III of the Air Navigation and Transport Act, 1988, to give effect to four 1975 Protocols to the Warsaw Convention. All four protocols have been ratified by Ireland. The Warsaw Convention established minimum levels of liability for, inter alia, the carriage of passengers and cargo; and the four protocols updated the compensation limits of the Warsaw Convention. However, the first two protocols only became part of international law in 1997. The question of making a commencement order to give effect to these two Protocols is being examined in the light of recent developments under EU legislation dealing with issues similar to those covered by the Warsaw Convention.
