Question:

264 Mr. Ring asked the Minister for Social, Community and Family Affairs when an appeal will be finalised for a person (details supplied) in County Mayo. [14180/98]

The person concerned was in receipt of disability benefit from 16 April 1996. Payment was disallowed by a deciding officer from 28 February 1998 following an examination by a medical assessor who considered that he was capable of work. The person concerned appealed this decision to the independent social welfare appeals office and in the context of his appeal he was examined by another medical assessor who was also of the opinion that he was capable of work. The case was referred to an appeals officer who was of the opinion that an oral hearing is necessary. This will be arranged as soon as possible.
