Question:

268 Ms Fitzgerald asked the Minister for Arts, Heritage, Gaeltacht and the Islands the EU directives coming wholly or partly under the auspices of her Department that were not fully implemented as of 1 June 1998; the reference number and subject matter of each directive; the deadline for implementation set out in the directive; whether it is proposed to implement the directive by means of a Bill or by statutory instrument; and when it is proposed to implement the directive. The following directives come within the categories referred to by the Deputy. Directive 97/36/EC of the European Parliament and of the Council of 30 June 1997 amending Council Directive 89/552/EEC on the co-ordination of certain provisions laid down by law, regulation or administrative action in Member States concerning the pursuit of television broadcasting activities. The deadline for implementation of this directive is 31 December 1998 but I propose to implement it before the deadline by means of primary legislation and statutory instrument; Council Directive No. 97/62/EC of 27 October 1997, adapting to technical and scientific progress Council Directive No. 92/43/EEC of 21 May 1992 on the conservation of natural habitats and of wild fauna and flora, known as the "Habitats Directive". This directive replaces Annexes I and II of the Habitats Directive and the deadline for implementation was 31 December 1997. It is proposed to implement the directive later this month by means of a statutory instrument amending the European Communities (Natural Habitats) Regulations, 1997.
