Michael Finucane

Question:

311 Mr. Finucane asked the Minister for Justice, Equality and Law Reform when a title to a property for a person (details supplied) in County Limerick will be finalised in view of the fact that the process has taken almost three years; and if he will make a statement on the matter. [14396/98]

I am informed by the Registrar of Titles that the dealing referred to by the Deputy was completed on 25 May 1998 and a new folio, 36584F County Limerick, opened.

John McGuinness

Question:

312 Mr. McGuinness asked the Minister for Justice, Equality and Law Reform if he will investigate the delay in registering folios in counties Carlow and Kilkenny for a person (details supplied) in County Kilkenny in view of the fact that all information has been submitted for some time and the courts have dealt with all other family claims to the property. [14449/98]

I am informed by the Registrar of Titles that this dealing refers to an application under section 49 (i.e. acquisition of title by virtue of long possession) of the Registration of Title Act, 1964, which was lodged on 4 July 1994. I understand that due to their complicated nature, applications under section 49, which require detailed examination of claims for registration as owners, take some time to process.

I am further informed that the Land Registry issued queries on this dealing to the applicant's solicitor on 31 July 1996 and replies are awaited. The queries raised must be satisfactorily discharged before the matter can proceed. Accordingly, it is not possible to estimate a completion date for the application concerned at this stage.
