Question:

325 Ms Fitzgerald asked the Minister for Education and Science the proposals, if any, for legislation being prepared under the auspices of his Department that have not yet been published; and the statutory instruments, if any, being prepared in his Department. [13988/98]

The legislative programme of the Government contains proposals for five Bills relating to matters under the auspices of my Department which are either at present being prepared in my Department or which it is proposed to publish during the term of office of the Government. The Bills are as follows: The Education and Training (Qualifications) Bill will establish a national structure for qualifications, provide for delegation of award making powers to institutes of technology and provide for related matters; the School Attendance (Amendment) Bill will up-date the law on school attendance; the Youth Work (Amendment) Bill will amend the Youth Work Act, 1997 to take account of the fact that it is not intended to establish intermediate education structures in the form of education boards; the Teaching Council Bill will establish a regulatory authority for the teaching profession; and the Vocational Education (Amendment) Bill will up-date aspects of the VEC structure.

As regards statutory instruments the following are being prepared in my Department: Rules and Programme for Secondary Schools 1998/1999; and European Communities (Second General System for the Recognition of Professional Education and Training) (Amendment) Regulations, 1998.

Question:

326 Ms Fitzgerald asked the Minister for Education and Science the Acts and provisions of Acts under the auspices of his Department which, as of 1 June 1998, are not in force because a commencement order has not been made; whether it is proposed to make an order in each case; and, if so, when this will be made. [14003/98]

There are no Acts or provisions of Acts under the auspices of my Department which are awaiting the making of a commencement order before coming into effect.
