149 Mr. Durkan asked the Minister for the Environment and Local Government the reason applicants for shared ownership loans are being required to appoint their own solicitor in the transaction, notwithstanding the role as set out in the scheme for the legal departments of the various local authorities; if his Department has changed the regulations in this regard; and if he will make a statement on the matter. [15574/98]

The administration of the shared ownership scheme is the responsibility of the local authorities. In accordance with the terms of the scheme, it is a matter for the applicant to choose whether or not to have independent legal advice on the transaction. My Department has no information to suggest that authorities are requiring shared ownership applicants generally to appoint their own solicitors.
