Question:

121 Mr. Creed asked the Minister for Agriculture and Food the position regarding the proposed sub-division of a commonage (details supplied) in County Cork. [20052/98]

This case appears to be one in which some but not all of the shareholders are in favour of division. An application was made to the Land Commission for compulsory division of the commonage under the Land Acts. A scheme for division was prepared but not approved before the Land Commission had suspended the use of its compulsory division powers and ceased work on all compulsory division cases as a result of an appeal to the High Court by objectors against the compulsory division of a commonage in County Mayo. An interim judgment was delivered in 1994 but the case is not yet finally resolved. The Land Commission will reassess its policy and procedures with regard to the compulsory division of commonage in the light of the final judgment of the court when delivered.
