Question:

214 Mr. G. Mitchell asked the Minister for Health and Children if the case of persons (details supplied) in Dublin 12 will be examined as their applications for refund under the community drugs refund scheme have been refused due to the fact that the pharmacy concerned is not part of the scheme; and when this matter will be resolved. [19916/98]

The application for a refund was refused on the basis that the pharmacy in question does not have a contract with the health board for the provision of community pharmacy services under the Health Act, 1970. The matter of the contract is still the subject of correspondence between the pharmacy's legal representatives and the health board. In the circumstances, the Deputy will appreciate that it would be inappropriate for me to comment on this case.
