Question:

358 Dr. Upton asked the Minister for Justice, Equality and Law Reform the guidelines his Department uses in relation to deportation, in particular if the deportee resists deportation; and if he will make a statement on the matter. [20574/98]

The operational details relating to escorting deportees from the State is a matter for the Garda Síochána. The normal procedures governing such matters as the use of restraint and force that apply to the treatment of persons in custody are followed and are governed by the Criminal Justice Act 1984 (Treatment of Persons in Custody in Garda Stations) Regulations, 1987.

Question:

359 Dr. Upton asked the Minister for Justice, Equality and Law Reform if he has raised with the Belgian authorities the recent death in Belgium of a person during deportation. [20576/98]

As the Deputy will know, this very regrettable event has had far reaching consequences in Belgium and I do not consider that any useful purpose would be served by my raising the matter with the Belgian authorities.
