Written Answers - Road Traffic Offences.

Question:

19 Mr. Stagg asked the Minister for Justice, Equality and Law Reform if, further to Parliamentary Question No. 593 of 3 November 1998, any out of state lorry operator was prosecuted for road traffic offences that did not require arrest and charge procedures; if so, the way in which the summons was served on the defendant in view of the fact that section 50 of the Criminal Justice Act, 1994, has not been used to date for out of state service of summons; and if he will make a statement on the matter. As I indicated in my reply to the Deputy's question on 3 November 1998, I am informed by the Garda authorities that statistics in relation to the number of out of state operators prosecuted for road traffic offences that did not require arrest and charge procedures, are not compiled in such a way as to readily provide the details which the Deputy has requested.

Summonses can be served in number of ways. In view of the unavailability of the details of the prosecutions to which the Deputy refers, I cannot supply him with the information he requires on the serving of summonses.
