Question:

67 Mr. Allen asked the Minister for Education and Science if he will continue to defend cases seeking participation by private colleges running approved courses in State student grant schemes. [25881/98]

Legal proceedings have been instituted in the case of Patrick Jordan Junior, Patrick Jordan Senior, Raymond Kearns and Barry Acton v. the Minister for Education, Ireland and the Attorney General, regarding the non-inclusion of Portobello College within the free fees initiative. The State is defending these proceedings. I am not aware that any proceedings have been instituted by private colleges for inclusion within the student grant schemes.
