Question:

372 Mr. Penrose asked the Minister for Justice, Equality and Law Reform the steps, if any, he will take to have the application for registration of a person (details supplied) expedited in view of the fact the lands which are the subject of this application are now the subject of sale; and if he will make a statement on the matter. [27399/98]

I am informed by the Registrar of Titles that the first mentioned dealing refers to an application under section 49 of the Registration of Title Act, 1964 (i.e. acquisition of title by virtue of long possession) by the first applicant named by the Deputy for registration as owner of part of the folio mentioned. This application was lodged on 13 February 1996. I understand that due to their complicated nature, applications under section 49, which require detailed examination of claims for registration as owners, take some time to process.

The other two dealings mentioned by the Deputy are section 49 applications by other persons for registration as owners of other parts of the folio mentioned.

In relation to the first mentioned dealing I am further informed that the Land Registry issued queries on this dealing to the applicant's solicitor on 21 July 1998 and replies are awaited. The queries raised must be satisfactorily discharged before the matter can proceed. Accordingly, it is not possible to estimate a completion date for the application concerned at this stage.

However, I can assure the Deputy that the Land Registry will do everything possible to expedite the resolution of this application.
