Question:

23 Mr. Stagg asked the Minister for Justice, Equality and Law Reform if, further to Parliamentary Question No. 593 of 3 November 1998, any out of State lorry operator was prosecuted for road traffic offences that did not require arrest and charge procedures; if so, the way in which the summons was served on the defendant in view of the fact that section 50 of the Criminal Justice Act, 1994, has not been used to date for out of State service of summons; and if he will make a statement on the matter. I refer the Deputy to my replies to his questions of 3 November 1998 and 26 November 1998, on this subject. The position is still as set out in the replies.

One request for a summons to be served under section 50 of the Criminal Justice Act, 1994 on an out of State driver in respect of an alleged drink driving offence was received from the Garda authorities by my Department on 27 January 1999. The summons was transmitted to the UK authorities for service on 29 January 1999.
