49 Mr. Ferris asked the Minister for Public Enterprise if her attention has been drawn to the concerns expressed by the Radiological Protection Institute of Ireland in relation to the use of x-ray apparatus by chiropractors; and if she will make a statement on the matter. [4562/99]

I am addressing the concerns expressed by the Radiological Protection Institute of Ireland in relation to the use of X-ray equipment by chiropractors. The Radiological Protection (Amendment) Bill, 1998, which passed all Stages in the Seanad in December last and is due to be introduced into the Dáil soon, is designed to deal with the issues highlighted by the institute.

Under the Radiological Protection Act of 1991, the institute's licensing powers are restricted to ensuring that X-ray equipment is properly calibrated and maintained. The institute cannot take account of the competence of the personnel who operate the apparatus before granting a licence. The Bill to be debated in the Dáil soon will provide that the grant or retention of a licence for the use of X-ray apparatus will be subject to the applicant or holder meeting relevant competence requirements established for nuclear medicine and dentistry administered by the Medical and Dental Councils. Accordingly, the position relating to the use of such equipment by chiropractors will be regularised.
