A lease or licence under the Fore shore Acts, 1933 to 1998, is required by any individual, group or public authority wishing to undertake works generally, including the erection of structures, on State-owned foreshore. The club in question was granted a foreshore lease in 1951 for the erection of a clubhouse and other facilities on State-owned foreshore. The club is aware that it cannot undertake works or erect any structures on any additional area of State-owned foreshore without an additional foreshore lease.
If an application for an additional foreshore lease is received from the club, it will be publicly advertised for any interested person to comment thereon and those comments and the club's response will be duly considered before I make a decision on the application. A number of complaints alleging unauthorised encroachment by the club on State-owned foreshore were made to me over recent months but were found to have been without substance.
