Question:

51 Mr. Farrelly asked the Tánaiste and Minister for Enterprise, Trade and Employment if it has been brought to her attention that an association (details supplied) has been asked under section 119 of the Companies Act, 1963, to make available the names and addresses of all its members; if she will introduce a derogation on the grounds of the personal security of the ordinary members and particularly for the protection of those members who are current or past members of the Garda Síochána and the Permanent Defence Forces; and if she will make a statement on the matter. Section 119 of the Companies Act, 1963 provides, inter alia, for the inspection of the register and index of members of a company, for at least two hours each day, during business hours, by any member of the company and by any other person on payment of a prescribed fee.

My attention has not been drawn to a request made to the Irish Clay Pigeon Shooting Association, seeking, access to the names and addresses of its members.

The Registrar of Companies, informs me that the Irish Clay Pigeon Shooting Association Number (115884), which was incorporated on 31 July 1986 and whose registered address is at 20 Butterfield Drive, Rathfarnham, Dublin 14, has not filed annual returns since 7 February 1990 I have been advised that this company was on a strike off list and the first strike off notice was issued on 7 January 1999. However, the company was removed from the strike off list on 26 January 1999 on the basis that annual returns would be brought up to date. If such returns are not submitted within eight weeks the strike off procedure will be reactivated.

The legislation in force does not permit me to introduce any derogation to the inspection provisions relating to registers maintained under the Companies Acts, 1963-90.
