Question:

63 Mr. Bradford asked the Minister for Agriculture and Food when a person (details supplied) in County Cork will receive compensation for an animal disease problem. [6539/99]

At an appeal hearing in the Circuit Court in late January 1999, a judgment was given that the person named should be paid £500, that is, half of the grant entitlement, for part fulfilling the requirements in relation to the removal of two reactors in 1994.

A decision as to whether the Department will appeal this case to the High Court will be made shortly. If the decision taken is not to appeal the court decision, arrangements will be made to process grants as soon as possible thereafter. If the court decision is appealed, grant payment will be postponed pending the outcome of the appeal.
