Question:

82 Ms Fitzgerald asked the Minister for Health and Children the pension arrangements and sick pay arrangements for staff employed by the Eastern Health Board on a part-time temporary basis over an extended period of time (details supplied); and if he will make a statement on the matter. [6496/99]

I understand from the Eastern Health Board that the terms of the sick pay scheme for temporary officers have been applied to the officer concerned since the beginning of June 1998. Under the terms of the scheme, the chief executive officer has the discretion to extend the scheme where special circumstances apply and the officer concerned has had two extensions, on this basis, which brought her sick leave up to the 8 November 1998. The Eastern Health Board has indicated that no further application for extension has been received.

In relation to pension arrangements for the officer concerned, temporary officers may be entitled to a once off lump sum under the Gratuity to Non-pensionable Persons Regulations, 1984. Under these regulations, if a temporary officer has to resign due to permanent incapacity, they must have worked an aggregate of five years service, working ten or more hours a week, to qualify for a gratuity. In this case, the Eastern Health Board considers that the officer would qualify for a gratuity under these regulations. However, I understand from the Eastern Health Board that the officer has now returned to work with the board.
