Vol. 502 No. 1

Written Answers. - Court Rules.

Willie Penrose

Question:

92 Mr. Penrose asked the Minister for Justice, Equality and Law Reform the steps, if any, he has taken to put in place rules governing procedures under the Child Abduction and Enforcement of Custody Orders Act, 1991; and if he will make a statement on the matter. [7201/99]

As the law stands, it is a matter for the courts rules-making authorities to decide whether new or amended court rules are required in any given situation. My only function in the matter is to concur in the making of any rules submitted to me by those authorities and to cause them to be promulgated in the form of a statutory instrument.

I am aware, however, that rules in relation to the Child Abduction and Enforcement of Custody Orders Act, 1991, are currently being drafted by the Superior Courts Rules Committee. When these rules have been submitted to me, I will be in a position to take appropriate action.
