33 Mr. O'Shea asked the Tánaiste and Minister for Enterprise, Trade and Employment if she will publish the report of the authorised officer into Garuda Limited; and if she will make a statement on the matter. [8324/99]

51 Mrs. Owen asked the Tánaiste and Minister for Enterprise, Trade and Employment the reply, if any, she has received to her requests to two companies (details supplied) for permission to publish reports or submit these reports to other parties not covered under section 21(1) of the Companies Act, 1990; and if she will make a statement on the matter. I propose to take Questions Nos. 33 and 51 together.

Under section 21 of the Companies Act, 1990 information obtained using section 19 powers may only be published with the prior approval of the company concerned. Such approval was sought from Garuda Ltd. earlier this year. The company has however refused permission to publish the report on legal advice. I am considering, with my advisers, the most appropriate course of action to take in this matter.

With regard to Fashill Homes Ltd. I will shortly be seeking the company's approval to publish the report of the authorised officer.
