52 Mr. Lawlor asked the Minister for Public Enterprise if claims that the ESB is abusing its dominant market position are being investigated following accusations by the developers of the independent power station at Hartstown that necessary information is being withheld; and the changes, if any, to legislation being contemplated. [11194/99]

Complaints relating to abuse of a dominant position are a matter for the Compe tition Authority. I am aware various interests are anxious to get information relating to access to the transmission system and other technical information in order to progress their proposals. In my view ESB should be as open as possible in their role as operator of the transmission system. I am prepared to look into any specific complaints about refusal to respond to any reasonable request to provide information. The Electricity Regulation Bill, which will shortly commence Committee Stage, provides for the establishment of a Commission for Electricity Regulation. This commission will have responsibility for approving the grid code and use of system charges.
