85 Mr. Broughan asked the Minister for Justice, Equality and Law Reform if he will request the Garda Commissioner to review the case of a person (details supplied) in Dublin 13 in view of the fact she was informed she successfully competed for entry to An Garda Síochána but was subsequently informed otherwise. My Department has no direct function in relation to the recruitment of individual gardaí. Admission to the Garda Síochána is a matter for the Garda Commissioner and is governed by the Garda Síochána (Admissions and Appointments) Regulations, 1988, as amended.

The person concerned was an applicant in the 1997 Garda recruitment competition and was successful in the written tests and interview conducted by the Civil Service Commission. However, article 5(2) of the regulations mentioned above provides that the Garda Commissioner, notwithstanding any other provision in the regulations, shall not admit a person as a trainee, if it appears to him that the person is generally unsuitable for such admission. The application of the person concerned was refused under this provision.

Following her success in the Civil Service Commission elements of the selection process, the applicant was advised that her admission as a trainee was a matter for the Garda Commissioner.
