Question:

79 Mr. Aylward asked the Minister for the Marine and Natural Resources the reason for the long delay by his Department in serving a notice under section 117 of the Fisheries (Consolidation) Act, 1959, on the owners of the weir and dam at Portlaw, County Waterford, to ensure the free passage and migration of fish. [14546/99]

There are still a number of matters to be finalised in this application, specifically whether the works in question require planning permission, and whether the existing weir is of particular historical importance. My Department has been in contact with both Waterford County Council and Dúchas on this matter, and will endeavour to bring the matter to an early conclusion.
