Question:

101 Mr. Higgins (Dublin West) asked the Minister for Agriculture and Food if all planning regulations, including those relating to fencing, are complied with by REP scheme applicants before approval of their payments. [17097/99]

The REP scheme specifications clearly set out that the Local Government (Planning and Development) Acts and regulations must be complied with by participants. Each year on-farm compliance checks are carried out on 50 per cent of the participants in the scheme. If it is found that participants have not complied with the conditions of the scheme, penalties are imposed.
