Question:

189 Mr. Durkan asked the Minister for Social, Community and Family Affairs when unemployment benefit or unemployment assistance will be paid to a person (details supplied) in County Kildare whose employer terminated his employment when the employee inquired if PAYE or other deductions were being returned in respect of this employment; if his Department has checked the employers record in this case; and if he will make a statement on the matter. The person concerned was in receipt of unemployment assistance from 21 January 1997 to 6 March 1999 when he commenced work.

He made a repeat claim for unemployment assistance on 22 April 1999 stating that he had been employed from 8 March 1999 to 21 April 1999. Following an examination of his case, his claim was disallowed on the grounds that he was not genuinely seeking work and had failed to submit sufficient evidence that he was making genuine efforts in seeking employment.

Notification of the decision and of his right to appeal issued on 6 May 1999. The person concerned made an appeal to the independent Social Welfare Appeals Office on 21 June 1999 which will be in touch with him in due course.

It is open to the person concerned to apply for supplementary welfare allowance while awaiting the outcome of his appeal. He called to the community welfare officer on 16 June 1999 and was advised that payment could not be made in the absence of certain documentation. He has not been in touch since.

The person concerned has submitted certain information concerning his employment and this is being verified. If necessary inquiries will be made of the employer concerned.
