Electricity Regulation Bill, 1998: Amendment from Seanad.

I move that the Committee agree with the Seanad in amendment No. 1:

Section 9: In page 11, subsection 3(a), line 9, after "Board" to insert "or between applicants for authorisations or licences".

The Seanad has made one amendment to the Bill as above. This is an amendment to section 9(3)(a). The section will now read as follows:

It shall be the duty of the Minister and the Commission to carry out their functions and exercise their powers in a manner which–

(a) does not discriminate unfairly between holders of licences authorisations and the Board or between applicants for authorisations or licences.

This amendment was tabled by Senators Costello, Gallagher, Ryan and O'Meara. It pro vides that the Minister and the commission would have to carry out their functions in a manner which does not discriminate unfairly between holders of licences authorisations and the board or between applicants for authorisations or licences.

I understood, but I may not have got it correctly, that the amendment was to section 2, page 6, line 4, to delete "gross" and substitute "net".

That amendment was discussed in the Seanad but not accepted.

I welcome the Government's decision to accept this amendment. It enhances the Bill and will remove fears expressed from the time we finished dealing with it here. Subsequent to that fears were expressed about a subsection that had been removed. This amendment will allay fears in that regard. I thank the Minister for accepting it.

Agreement to Seanad amendment is reported to the House and a message will be sent to Seanad Éireann acquainting it accordingly.
