229 Mr. Enright asked the Minister for Agriculture, Food and Rural Development when a REP scheme payment due since June 1999 will be paid to a person (details supplied) in County Offaly; and the reason for the delay in expediting this payment. [21315/99]

261 Mr. Flanagan asked the Minister for Agriculture, Food and Rural Development when a REP scheme payment will be made to a person (details supplied) in County Offaly. [21620/99]

I propose to take Question Nos. 229 and 261 together.

The person named applied for a fifth year REPS payment. The application was chosen at random for a pre-payment inspection. The inspection has been completed and the application can now be processed.

Question:

230 Mr. G. Reynolds asked the Minister for Agriculture, Food and Rural Development when a person (details supplied) in County Sligo will receive 1999 cattle headage. [21415/99]

The person named included one single parcel of land totalling 14.97 hectares in his 1999 area aid application. Subsequent amendments to the Department's electronic mapping database showed the correct area of the parcel to be 14.11 hectares.

This represents a difference of 0.86 hectares or 6.09 per cent between the area claimed and that determined. Under Article 9 of EU Regulation 3887/92, no penalty is applied when the difference is less than 3 per cent, the penalty is based on double the difference when it is between 3 per cent and 20 per cent and when the difference is over 20 per cent, a 100 per cent penalty must be applied. Therefore in this case a penalty of 1.72 hectares has been applied, leaving the area determined 12.39 hectares. Any payments due will issue as soon as possible.

Dinny McGinley

Question:

232 Mr. McGinley asked the Minister for Agriculture, Food and Rural Development when 1999 sheep headage will be paid to a person (details supplied) in County Donegal. [21431/99]

The above named applicant has made a number of serious errors on his 1999 area aid application form. He has been contacted in this regard. No payments can issue until all outstanding problems have been resolved.
