(Mr. Walsh): I propose to take Questions Nos. 254, 255, 256, 257, 259 and 260 together.
The number of transactions, broken down between sales and leases which have been subject to clawback since 1996 are set out as follows.
My Department does not maintain records in relation to clawback in such form which would provide a breakdown of the cases in which clawback was applied based on quota size. All milk quota acquired through the application of the clawback measure is added to the national reserve. Allocations from that reserve are made from the total pool and are not related in any way to how these quantities were taken into the reserve.
Apart from family transactions exemption from clawback is provided for in cases of inheritance, renewals of existing land leases and certain sales. No clawback applies in the case of any sale of land where a lease of that land has not yet expired and where the purchaser of that land is either the original lessee and where there is no change in the operation/possession of the land in question or a person who has become entitled to the lessee's interest by way of inheritance.
