115 Mr. McGuinness asked the Tánaiste and Minister for Enterprise, Trade and Employment if a person (details supplied) in County Kilkenny is entitled to redundancy payment in view of the manner in which his employer closed the business and ceased trading. [21331/99]

According to my Department's records, this company is currently in liquidation. The Deputy may rest assured that all of its employees meeting the basic criteria under the Redundancy Payments Acts 1967-1991 will receive their statutory redundancy entitlements. Where an employer is unable or unwilling to pay, my Department, by virtue of its statutory responsibility in this area, will pay any qualifying redundant employees their statutory lump sums from the proceeds of the social insurance fund.

In the event of the liquidator not giving an employee the redundancy certificate required by this Department to make a redundancy lump sum payment, the employee may take steps to establish entitlement to such a sum by appealing to the Employment Appeals Tribunal. There is a 52 week time limit from the date of termination on this. The tribunal has discretion to extend this to 104 weeks.
