151 Ms Fitzgerald asked the Minister for Health and Children if he will request An Bord Altranais to carry out a full review of the case of an independent home birth midwife (details supplied) in view of the judgment lifting the injunction against her by the President of the High Court on 17 May 1999 stating that it was incumbent on the incoming board to review her case. 152 Ms Fitzgerald asked the Minister for Health and Children if he has satisfied himself that, in view of the judgment of the President of the High Court on 17 May 1999 lifting the injunction against a person (details supplied) citing the failure of An Bord Altranais to review the com plaints made against her, the procedures and rules governing the structure and functioning of the board's fitness to practice mechanisms are adequate to ensure natural justice and procedural fairness for persons accused of unfit to practice and professional misconduct; and if he will make a statement on the matter. [22953/99]

I propose to take Questions Nos. 151 and 152 together.

I have been informed by the chief executive officer of An Bord Altranais that both parties to the case referred to by the Deputy have appealed to the Supreme Court against the judgment of the High Court. In these circumstances, the Deputy will appreciate that it would be wholly inappropriate for me to make any comment in relation to the case.
