188 Mr. N. Ahern asked the Minister for the Environment and Local Government if he will amend section 37 of the Road Traffic Act, 1961, in view of the fact it is not logical to insist that a period of endorsement of a licence can only be served while holding a valid licence and this rule is militating against some long-term unemployed people who had endorsements served up to ten years ago and did not renew licences due to unemployment. Sections 36 and 37 of the Road Traffic Act, 1961, which have been more recently reviewed by section 49(1)(e) of the Road Traffic Act, 1994, provide that particulars of convictions for certain offences must be endorsed on a driving licence. Endorsements can only be carried on a current valid licence. The provisions of sections 36 and 37 will fall for further review in the context of the proposed introduction of a penalty points system.
