Vol. 511 No. 1

Written Answers. - Compulsory Purchase Order.

Dick Roche

Question:

144 Mr. Roche asked the Minister for the Environment and Local Government if he will examine the case of persons (details supplied) in County Wicklow in relation to a compulsory purchase order on their house; and if he will make a statement on the matter. [23771/99]

The Wicklow County Council Compulsory Purchase (Kilmacanogue-Glen of the Downs Dual Carriageway) No. 1 Order 1995, which included property of the persons referred to, was confirmed, subject to modification, on 23 January 1997. The administration of the order is a matter for the local authority. The amount of compensation payable by local authorities for land acquired by them on the authorisation of a duly confirmed compulsory purchase order is a matter for negotiation between the local authority and the property owners concerned. In the event of dispute either party has recourse to the land values reference committee for the appointment of an official property arbitrator to determine the case.
