141 Mr. Ring asked the Minister for Agriculture, Food and Rural Development when a person (details supplied) in County Mayo will receive 1999 cattle headage and premia. [24129/99]

The person named included commonage in his 1999 area aid application but did not provide proof of his entitlement to claim this commonage. The herdowner has been informed of this and his application cannot be processed further until this proof is provided.

An overclaim has been identified on one of the land parcels claimed by the person named in 1999. Maps have issued to him and he has been informed of the extent of this overclaim.

In addition the person named also included commonage in his 1999 area aid application but did not provide proof of his entitlement to claim this commonage. The herdowner has also been contacted in this regard. No payments can issue until all these outstanding issues have been resolved.

There are various problems with the 1999 area aid application submitted by the person named. My Department has contacted him and outlined each problem and is awaiting a response. No payments can issue until this matter has been satisfactorily resolved.

There are no area aid related difficulties with the REPS application of the person named. However, the person named has been contacted in connection with difficulties relating to his REPS application.

148 Mr. Ring asked the Minister for Agriculture, Food and Rural Development when a person (details supplied) in County Mayo will receive a REP scheme payment. [24137/99]

The person concerned applied for a fourth year REPS payment on 29 September 1999. The area claimed under the scheme was 10.27 hectares, however, the area under area aid was 3.29 hectares.

Officials from my Department wrote to the applicant on 12 October 1999 seeking an explanation regarding this discrepancy. To date no reply has been received by my Department. On receipt of an explanation, the application will be processed as soon as possible.

The person named submitted an incomplete 1999 area aid application form. He did not indicate the area of a parcel of land included in his application and did not provide proof of his entitlement to claim on commonage parcels. He has been contacted in this regard. No payments can issue until all outstanding problems have been resolved.

150 Mr. Higgins (Mayo) asked the Minister for Agriculture, Food and Rural Development the reason a person (details supplied) in County Mayo has not received headage payment. [24139/99]

The person named was paid his full entitlement of £2,316.00 under the 1999 cattle headage scheme on 19 November 1999.

Payment of his full entitlement of £40 under the 1999 sheep headage scheme has now issued to him.

151 Mr. Ring asked the Minister for Agriculture, Food and Rural Development the steps, if any, he is taking to resolve the difficulties with commonage (details supplied) in County Mayo; and if he will attend a public meeting in Geesala to meet the herd owners affected and resolve the problems. In the estate commonage referred to there are more than 40 herdowners claiming a variety of different commonages held in different share values. The commonages in question, as elsewhere, have been the source of serious difficulties in processing area aid applications this year, mainly because farmers have not provided adequate proof of entitlement to such commonages.

My Department recently advertised in local newspapers in a number of counties, including Mayo, urging farmers to supply the necessary proofs in order to advance the processing of the relevant area aid applications. My Department will continue to endeavour to resolve all commonage difficulties as soon as possible.

152 Mr. Finucane asked the Minister for Agriculture, Food and Rural Development when headage, beef premium and cow suckler grants and payment under the REP scheme will be made to a person (details supplied) in County Limerick. [24263/99]

The person named was paid as follows: 1999 suckler cow premium, £79.88, 1/11/99; 1999 special beef premium, £988.37, 1/11/99. No applications were made under the 1999 cattle or sheep headage schemes from this herdowner. The person named will receive payment in respect of the REP scheme within the next ten days.

John McGuinness

Question:

153 Mr. McGuinness asked the Minister for Agriculture, Food and Rural Development if he will examine the case of a person (details supplied) in County Carlow and restore full headage and premia payments in view of the fact that no fraud was intended, a genuine error occurred and the number of cattle as stated were on the farm. [24275/99]

The person named applied under the 1999 suckler cow scheme and the 1999 beef cow scheme on 3 June 1999.

At an on-farm inspection carried out on 14 October 1999 it was found that one of the animals entered on the claim was not in the applicant's ownership and possession on the date of application. Furthermore the animal in question was deemed to be a dry heifer and was, therefore, ineligible for the suckler cow premium scheme or the beef cow scheme.

The person named made a false declaration and the penalty for this will be conveyed to him by letter shortly. It will then be open to him to seek a review of the case if he is not satisfied with the decision taken.
