Question:

334 Mr. Timmins asked the Minister for Justice, Equality and Law Reform if he will implement a system whereby a person who produces documentation for inspection at a Garda station will be issued with a certificate to that effect in view of the fact that the recording of this has given rise to dispute on occasion. [24450/99]

I am informed by the Garda authorities that section 40(1) of the Road traffic Act, 1961, provides for the production of a driving licence at a Garda station and that a similar provision applies regarding the production of a certificate of insurance where the same is demanded by a member of the Garda Síochána under section 69(1) Road Traffic Act, 1961.

I am informed by the Garda authorities that the information is recorded in a register of driving licences and certificates of insurance produced and I am assured by the Garda authorities that the existing system has been found to be satisfactory over the years.

I understand that the legislation referred to does not provide for the issuing of a receipt on production of such documents and that an amendment to this legislation would be a matter for the Minister for the Environment and Local Government.
