Vol. 511 No. 5

Written Answers. - Registration of Title.

Willie Penrose

Question:

89 Mr. Penrose asked the Minister for Justice, Equality and Law Reform if an application for title registration by a person (details supplied) will be finalised as quickly as possible; and if he will make a statement on the matter. [24808/99]

I am informed by the Registrar of Titles that this application refers to a Land Commission schedule which was lodged on 26 September 1997. Land Commission vesting orders and schedules are deemed to be registered as of the date of vesting which is prior to the date of lodgement of the documents in the Land Registry. Accordingly, registration in the Land Registry of Land Commission cases is afforded a lower priority than the registration of other dealings.

Where a specific need arises which requires that such registration be effected, for example, a further transaction affecting the land in question, the Land Registry processes the Land Commission case without delay.

In relation to the case referred to by the Deputy, I am further informed that the Land Registry issued queries regarding this schedule to the Department of Agriculture and Food on 10 February 1999 and a reminder issued on 22 November 1999. The matter cannot proceed until these queries have been satisfactorily resolved.
I assure the Deputy, however, that there will be no undue delay on the part of the Land Registry in bringing the matter to conclusion.
